Dexter, MI — A woman who was paralyzed after being thrown from a horse-drawn wagon has sued her employer, Jenny’s Dexter Market in Webster Township, in excess of $25,000. The Ann Arbor woman sued Jenny’s Dexter Market Tuesday, January 3, 2011, in Washtenaw County Circuit Court, reported Ann Arbor.com.
Mary Armbruster, 23, filed the lawsuit against Jenny’s Dexter Market; the owner, Jennifer Lambers; and Lanbers’ father and business operator, Burton Hoey.
Armbruster spent more than two months in the hospital and was paralyzed from the waist down, as a result of being thrown from a wagon as she was giving a hayride on the property. Armbruster was reportedly trying to gain control of the horses, when she was thrown on Sept. 24.
Since the accident Armbruster was incurred hundreds of thousands of dollars in current and future medical bills, as well as continuing to suffer physical and mental pain.
Armbruster claims that she was given faulty equipment to give customer hayrides, which weren’t fixed after she complained about it. She was given two mismatched and uneven reins for a two-horse team, which caused her to “have to hold one rein in each hand to adequately steer the two horses,” the lawsuit states.
The seat on the wagon was also not bolted down to the wagon.
Court documents revealed that Armbruster was pulling back on the reins while seated on the wagon, in order to keep the horses from running down, a hill when the seat came loose. This caused Armbruster to stand on the wagon while she tried to slow the horses, when they suddenly bolted. Armbruster tried to stop the horses so they wouldn’t enter the road, and instead “was jerked off the front of the wagon, and was run over,” the lawsuit read.
The lawsuit asserts that Jenny’s Dexter Market set a “course for the hayride which required the wagon to be driven down a steep, dangerously unsafe hill with uneven ground.”
