Trademark Infringement Lawsuit: Madonna Sued Over “Material Girl”

Los Angeles, CA—The “Material Girl” herself, Madonna, has been sued over the trademark “Material Girl” by an apparel manufacturer, who claims they have been selling clothes under that trademark since 1997, as reported by CNN.

LA Triumph filed the trademark infringement lawsuit on Thursday, August 19, 2010, which claims that Madonna does have the right to “trade in the same space under this brand.” The “Material Girl” clothing by LA Triumph is reportedly offered in stores like Nordstrom’s and Ross.

Madonna and her daughter Lourdes reportedly designed the trendy clothing collection together, and dubbed it “Material Girl.”

LA Triumph’s attorneys stated, “Our client and its predecessor have been continually selling similar clothes in similar retail outlets at similar price points under their Material Girl brand since at least 1997 and Madonna and her newfound company do not have the right to trade in the same space under this brand. The attorney said their client faces ‘a risk of being subsumed by Madonna’s profile, obvious worldwide notoriety’ and massive marketing campaign.”

Madonna’s “Material Girl” collection, which is touted by Gossip Girl star Taylor Momsen, is available at Macy’s, where it was launched earlier this month.
