Flint, MI—A woman who claims she was forced into undergoing an abortion filed a seven-count lawsuit and criminal complaint against the doctor who carried out the procedure. The lawsuit was filed in Genesee County Circuit Court, according to information provided by ConnectMidMichigan.com on May 24, 2010.
Reports indicated Caitlin Bruce, 20, reported to Flint-based Feminine Health Care Clinic to have an abortion. However, upon seeing the ultrasound imagine of her unborn child, she had a change of heart.
According to Bruce, “He was inserting the speculum, and I told him I’m nervous. I just told him stop please… I’m really nervous and I don’t want to do this anymore.”
Nonetheless, Dr. Abraham A. Hodari stated, “When she said stop, it was too late… I told her I would stop, but when I take my instrument there was blood and tissue on it from pregnancy, so I couldn’t stop.” Dr. Hodari allegedly had a nurse hold Bruce down so he could finish what he had already started.
Dr. Hodari contends had he have stopped the procedure, Bruce could have potentially suffered a life-threatening infection or severe bleeding. “I am there because I want to help woman have safe abortions… Look at my records. I have done more abortions and longer than any doctor in Michigan.”
Conversely, obstetrician and gynecologist Dr. Mona Hardas, M.D., disputed the way Dr. Hodari handled the situation. Dr. Hardas stated, “Even if someone has signed a consent form, if someone wants you to stop you have to stop… I am shocked… I can’t believe this is still happening in this day and age.”
Dr. Hardas noted that there were several other ways Dr. Hodari could have approached the conflict. For instance, he could have suggested that Bruce be taken to the ER for examination and a second opinion on the issue.
A few weeks after Bruce underwent the abortion, she attempted to commit suicide, adding that the terrifying experience changed her life.
Dr. Hodari was subsequently sued and faces the following counts:
• Count I—Lack of informed consent; Medical Malpractice
• Count II—Battery
• Count III—Misrepresentation; Fraud
• Count IV—Innocent Misrepresentation
• Count V—Intentional Infliction of Emotional Distress
• Count VI—Ethnic/Gender Intimidation
• Count VII—Violating the Elliot Larson Civil Rights Act
Though a police report was filled, Dr. Hodari has not been charged as of yet. The case continues.
