Hartford County, MD—A civil jury returned a medical malpractice verdict that awarded a plaintiff $3.5 million on Thursday, May 13, 2010. The case stems from the permanent injuries a woman sustained while undergoing a surgical procedure in 2007, according to information provided by the Baltimore Sun.
Reports stated 53-year-old Victoria Little required surgery for blocked arteries in 2007. In response to her condition, she sought out medical attention from Dr. Roger E. Schneider, chairman of Upper Chesapeake Health System, and his partner, Dr. Mark D. Gonze.
The procedure did not go as planned. Little was consequently left with a spinal chord injury. She was also left a paraplegic and suffered other forms of bodily damage, prompting her to file a medical malpractice lawsuit in 2008. The suit was filed in Hartford County Circuit Court.
Little’s attorney apparently contended Dr. Roger E. Schneider and Dr. Mark D. Gonze used an inappropriate grafting technique, causing her to suffer an array of serious injuries. Her lawyers also alleged that while she still has some feeling in her legs, she is unable to walk and endures inexorable pain.
After nine hours of consideration, the jury announced its ruling. Little was awarded $1.3 million in non-economic damages, $2 million to cover her future medical expenses, and more than $200,000 to compensate her for preceding medical bills.
Lawyers representing the doctors and their business, Vascular Surgery Associates, claimed such surgical complications are known to occur “in the best of hands”. The defendants’ attorney noted, “This is a nice lady who had a poor outcome, but it was not malpractice by these two well-trained surgeons… We are reviewing the case for appeal.”
