On November 10, 1998, Mark Roberts was employed as manager of a loading dock at a local department store when a co-employee drove a pallet jack into his knee, causing internal derangement. Mr. Roberts sought assistance with his claim for workers compensation benefits with the law offices of Rue & Ziffra. On June 27, 2004, Mr. Roberts suffered a catastrophic stroke leaving him aphasic and totally disabled. Working with a series of experts, Attorney David Sweat pursued a theory of causation linking the usage of Bextra to the onset of stroke and Mr. Roberts’ disability. The case ultimately went to trial and the Judge of Compensation Claims ruled in favor of Mr. Roberts on the relationship between the Bextra prescribed by the workers compensation authorized treating surgeon and Mr. Roberts’ stroke and ensuing disability.
As a result of the litigation, Mr. Roberts was able to secure significant benefits both in terms of lost wages, attendant care, and medical care and treatment related to the stroke.
Recently the parties engaged in settlement discussions and reached an agreement to settle the workers’ compensation case for over $500,000. Mr. Roberts’ access to medical care and treatment through Medicare was preserved through the settlement process and the family looks forward to access to these financial resources to compensate him for his and his family’s future needs. As of the date of this writing, Rue & Ziffra is not aware of any other trial verdicts linking Bextra to strokes.
