Wrongful death lawsuit filed after woman sustained a fatal brain injury in a Route 31 traffic accident.
West Dundee, IL—A traffic accident in which a pedestrian was fatally injured in August after attempting to cross the road has led to a wrongful death lawsuit, filed by the woman’s estate in Kane County Circuit Court last week, according to information provided by the Daily Herald.
The fatal traffic accident occurred on August 25, 2009, at approximately 10 a.m. It was reported that 66-year-old nurse Diane J. Bonitzer was leaving the post office and began to walk across Route 31, when she was struck by a 2007 Chevrolet Silverado. Reports indicate the severe skull and brain injuries she sustained proved fatal approximately an hour after the incident.
The 31-year-old Silverado driver, Francisco Rodriguez, is allegedly being sued by Bonitzer’s estate for his failure to “honk, drive safe, or pay attention”. Police reportedly gave the driver a citation for his failure to yield to a pedestrian and also his failure to exercise due care. It was reported that toxicology reports stated that the driver had not been using drugs or alcohol at the time of the fatal crash. Police officials reported stated that Rodriguez allegedly claimed that he did not notice Bonitzer crossing Route 31 after he turned onto the roadway from Willow Lane. He reportedly seemed distraught by the incident.
The wrongful death lawsuit will allegedly go before Judge Judith M. Brawka on April 1, 2010.
