NCLA and the rodden Plaintiffs claim that on the bench Court of Appeals for the Fifth Circuit to uphold the U.S. District Court for the Southern District of Texas’ original injunction against President Biden’s unprecedented vaccination mandate. A split Fifth Circuit panel in April cleared the statewide injunction against the vaccination mandate for federal employees, which ruled that the Civil Service Reform Act of 1978 (CSRA) precluded a district court review of federal employee challenges. The panel’s flawed decision protects unlawful government mandates against federal employees from judicial review and would allow only a case-by-case administrative determination of class-wide constitutional violations. The refusal to review these executive hiring decisions except in the context of individual disciplinary procedures opens the door to arbitrary and repressive government action aimed at intimidating employees into losing their careers. More than 10 million federal employees and contractors are currently required to give up health autonomy as a condition of working for the federal government.
