Colorado – A woman accused of cutting the seven month old fetus out of a woman she lured to her home via Craigslist reportedly won’t be facing murder charges in connection with the incident. As reported by WebProNews, the woman, 34-year-old Dynel Lane allegedly beat and stabbed 26-year-old Michelle Wilkins in the attack and left her to die.
Wilkins’ survived the incident and has since been released from the hospital; however. Her unborn baby did not survive.
Lane reportedly told her family that she had been pregnant, and was found covered in blood by her husband following the incident. The baby had been placed in a bathtub. Lane told her husband and doctors that she had had a miscarriage.
In accordance with Colorado’s fetal homicide laws, a baby must exhibit signs of life outside of the womb in order to be deemed a homicide victim. District Attorney Stan Garnett is quoted as stating to the Denver Post of the decision to not file a murder charge in the case, “Under Colorado law, essentially, there is no way murder charges can be brought if it’s not established that the fetus lived as a child outside the body of the mother.”
