MLB seeks dismissal of suit over move for Oakland A’s

San Jose – Major League Baseball is seeking the dismissal of a lawsuit filed by San Jose alleging the organization illegally blocked the Oakland A’s move to the city. As reported by the San Jose Mercury News, the first hearing before a federal judge regarding the case was held on Friday.

Attorneys for MLB requested that the antitrust lawsuit filed by the city be dismissed asserting other rulings by the U.S. Supreme Court determined that laws that prohibit monopolies are not applicable to baseball.

MLB is quoted in the report as stating in legal briefs, “The Supreme Court has repeatedly held that it is ‘business of baseball’ that is exempt from antitrust scrutiny.”

Attorneys for San Jose have argued otherwise stating in legal briefs, “Major League Baseball as a sport emphasizes competition… Yet Major League Baseball as a business refuses to believe it is subject to the same antitrust rules that apply to all other sports.”
