Georgia – An Atlanta judge has denied Tameka Foster’s request for temporary primary custody of the two sons she shares with R&B singer Usher. As reported by Reuters, Fulton County Superior Court Judge John J. Goger dismissed the motion on Friday citing the recent accident of their 5-year-old son was not reason enough for removing custody from the Grammy winning entertainer.
Foster filed the petition on Tuesday after their son was hospitalized in connection with a swimming pool accident at Usher’s home. The singer, whose real name is Usher Raymond IV, was not at home at the time of the incident, and the child had been left in the care of his aunt Rena Oden. The 5-year-old is reportedly now recovering from the accident.
Goger is quoted by Reuters as stating in his decision, “What happened here was an awful accident… Based on the evidence here, I’m not certain that one person could have done any better than Ms. Oden. Ms. Oden did impress me.”
Usher and Foster were married in 2007 and divorced after nearly two years.
