SC, hospital sued over child’s sex assignment surgery

South Carolina – The state of South Carolina and two hospitals have been named in a lawsuit regarding the sex assignment surgery performed on a toddler. As reported by the Associated Press (AP), the toddler’s adopted parents filed the lawsuit against the state claiming the surgery was unnecessary and that the hospitals involved were negligent.

The child, who was born with male and female genitalia, was given surgery to remove the male genitalia at 16 months and raised as a girl. Attorneys for the couple assert in the lawsuit that the surgery should have been postponed until the child was able to identify as female or male.

Lawyer Ken Suggs is quoted by the AP as stating of the suit, which is deemed the first in the U.S. of its type, “That was a permanent, irreversible decision that was not theirs to make.”
