On August 21, 2012, NY medical malpractice attorney Jonathan C. Reiter obtained a verdict of $750,000 plus $24,021 in medical expenses from a Rockland County, New York jury on behalf of his client, Dennis E. Jenny, a 64 year old man whose ureter was injured during abdominal surgery. The case was tried before Supreme Court Justice Linda Jamieson.
The plaintiff had undergone laparoscopic sigmoid colon resection on January 30, 2007 for recurrent diverticulitis. Seven days post-operatively, he was diagnosed with a collection of urine in his abdomen and pelvis due to a hole in his left ureter. It was admitted by the defendant surgeon that the injury to the ureter was caused by the surgery, although the doctor claimed that he performed the surgery correctly and saw no evidence of damage to the ureter at the time of the operation. Plaintiff’s expert testified however that the surgeon deviated from the standard of care by injuring the ureter with the harmonic scalpel, an instrument used during the surgery to cut and cauterize adhesions around the bowel.
Plaintiff’s ureteral injury necessitated CT guided drainage of over a liter of urine from his abdomen as well as operative stenting of the ureter for three months, during which time he suffered multiple urinary tract infections and pain. Due to antibiotic treatment, he also developed a C-difficile infection that caused severe diarrhea and abdominal pain. The stent was removed after three months and plaintiff ultimately recovered from the multiple infections.
