While the Arizona Supreme Court remanded a case back to the trial court to determine whether a victim’s private attorney fees can be recovered as criminal restitution, the court provided “broad guidance” for lower courts to consider in what it called a “recurring issue of statewide importance.”
The matter came before the court after a victim of voyeurism was awarded fees for retaining an attorney to represent her in the criminal proceedings involving the defendant, Richard Allen Reed.
