Tennessee – A lawsuit has been filed by a man accused of writing a racial slur on a Red Lobster receipt last year. As reported by WSMV, Devin Barnes filed the suit against the restaurant chain and Toni Jenkins, the waitress who accused him of writing the n-word on his receipt, Thursday alleging he and his family have suffered since the story about it gained widespread media attention.
Barnes is suing Jenkins for making a posting of the receipt online, which included his personal information, as well as receiving donations based on her story. He is suing the restaurant for how the situation was handled.
Red Lobster is quoted as writing in a statement regarding the incident, “it is against our policy to post guest information online. Our standard procedure is to suspend the employee involved with pay while we determine what happened. After the completion of a full investigation into this matter, Ms. Jenkins returned to work.”
A reported $1 million is being sought in the case, and a request has been made for a jury trial.
