Tacoma – A Washington judge has ordered Tacoma police to return marijuana seized in a traffic stop. As reported by the Associated Press (AP), Municipal Court Judge Jack Emery ordered the return of the drug to Joseph L. Robertson and stated the department would be held in contempt if they do not comply with the order.

The judge first made the order in February, with the department refusing to comply. The drug was seized from Robertson during a traffic stop, and a related drug charge was dismissed following the legalization of small amounts of marijuana by state voters. He then requested the drug back.

The matter could be taken to higher courts if it is not resolved during a hearing May 2.
