Charlotte-Mecklenburg Officials to Probe Collision Involving Police SUV, Minivan

Charlotte, NC—A Charlotte-Mecklenburg Police Department SUV that was en route to a call regarding a foot chase crashed into a minivan Monday, January 3, 2010, seriously injuring the driver. The accident, which left a 43-year-old nurse with “serious head injuries,” happened at the intersection of Briar Creek and Monroe roads around 9:30 a.m., as reported by the Charlotte Observer.

According to information provided, CMPD Canine Officer Cory Milbourn was driving a police SUV without its lights and sirens activated as he headed toward the Grier Heights community to assist another officer in a foot pursuit.

Simultaneously, Kay Guillermina Floyd, who was operating the minivan, made a left turn from Briar Creek Road onto Monroe Road. Although Floyd had the right of way, the police SUV sped through the intersection, consequently T-boning the minivan.

Floyd was ejected from her minivan on impact of the crash. Emergency medical services (EMS) personnel rushed her to Carolinas Medical Center, where she was listed in stable condition as of Monday night.

The police vehicle was reportedly traveling at about 45 mph in a 35-mph zone when the collision occurred. Though police officers are permitted to exceed the speed limit if they use their lights and sirens to warn other drivers, Milbourn was not in adherence with the department’s regulations or state law at the time.

While Milbourn apparently sustained minor injuries in the SUV accident, it was not clear if he required further medical attention. As of Monday night, no charges had been filed against the CMPD officer, nor was he placed on administrative leave.

Investigations were expected to be underway.
