Syracuse, NY—Two New Jersey bus companies and the driver of the Megabus that crashed in Upstate New York last month, killing four people and injuring 25 others, were sued Friday, October 15, 2010. A South Jersey woman filed the negligence lawsuit, which blames Coach USA, Olympic Trails Bus Co. and Megabus driver John Tomaszewski for the head, neck and back injuries she sustained, according to the Philadelphia Inquirer.
The personal injury suit claims the Syracuse double-decker bus wreck left the 26-year-old plaintiff with “significant cognitive impairments” such as attention and memory-related difficulties.
Candice Burks of Mount Laurel filed a lawsuit in Common Pleas Court after the Megabus she was aboard crashed into a CSX railroad overpass on September 11, 2010.
The lawsuit noted there were several warning signs and flashing yellow lights in place to alert drivers of the low bridge ahead. According to Onondaga County Sheriff Kevin Walsh, “Obviously the driver didn’t see the signs or didn’t realize the height of his bus, that the double-decker bus wouldn’t fit under that bridge.”
The deadly accident, which occurred as the Megabus traveled from Philadelphia to Toronto, left Burks with head, neck, and back injuries.
The plaintiff’s attorney maintained brain injuries have the potential to have long-lasting or even permanent effects on crash victims.
Burks is apparently seeking more than $50,000 in compensatory damages.
The case continues.
