Batavia, NY (New York Injury Lawyer News)—An Ohio man who admitted to watching porn before crashing his semi into a disabled vehicle, which consequently claimed the life of a mother of two, was sentenced to three to nine years in prison. The tragic motor vehicle collision (MVC) occurred along the New York State Thruway before noon on December 12, 2009. Genesee County Judge Robert C. Noonan announced the sentence Wednesday, September 1, 2010, stating the defendant, 45-year-old Thomas M. Wallace, must be held accountable for his “reckless” actions. While Wallace expressed remorse for his wrongdoing, the victim’s family is expected to file a civil lawsuit against him and his employer, according to information provided by the Buffalo News.
Reports indicated 33-year-old Julie I. Stratton of Snyder had just dropped her two young sons, ages 1 and 4, off at home and was traveling westbound on the Thruway when her vehicle struck a deer. She subsequently called her husband, Michael, and then 911. However, a distracted Wallace failed to notice Stratton’s disabled vehicle. His 18-wheeler violently slammed into the back of her car, leaving her with fatal injuries. “It is because of Mr. Wallace’s disrespect for our laws and his complete and disgusting lack of concern for others that we are all here today,” Michael Stratton contended tearfully.
Wallace initially claimed he was examining traffic through his mirrors, adding that his laptop was in his sleeping berth. He then admitted to listening to pornographic films from his laptop, alleging he took a peek at them intermittently. Tests conducted at the Western New York Regional Computer Forensic Lab found that he had in fact clicked on several different porno movies before crashing his tractor-trailer into Stratton’s car. Officials also reported he violated federal regulations by driving on only 4 ½ hours of sleep within a 27-hour span prior to the deadly wreck. County Judge Robert C. Noonan told Wallace in court Wednesday, “Your conduct on this day, I can’t think of any other way to say it, was just grossly, grossly irresponsible.”
