Santa Ana, CA– The man who bit down on a condom while eating a soup at a Claim Jumper has finally reached settlement with the restaurant chain. The Claim Jumper and Zdenek Phillip Houdousek settled on Wednesday, August 25, 2010, on undisclosed terms, as reported by MSNBC.

The settlement does not indicate any admission of liability from either party. Houdousek filed the lawsuit last summer in the Superior Court, which sought unspecified damages.

As previously reported in, “California Injury Lawsuit: Man sues Claim Jumper After Chewing on Condom in Soup,” Zdenek Philip Hodousek, 51, his wife, Sherry, and their 18-year-old daughter reportedly went to a Mission Viejo Claim Jumper restaurant for Easter Brunch on April 12, 2009. While Zdenek was enjoying a bowl of french onion soup, he bit down on what he thought was a tough piece of cheese on the side of his mouth. After trying to tear apart the “tough piece cheese” for a minute, he pulled it from inside his mouth and discovered it was actually a condom.

Houdousek reportedly had tested by Lab Corp in North Carolina, which showed there was female DNA. But the restaurant refutes the claims, and subsequently conducted their own testing, but they have not provided all the results.

Claim Jumper says it has found no evidence of a foreign object in their soup, and deny that any employee was involved in any wrongdoing.
